The U.S. Environmental Protection Agency (EPA), Cincinnati Acquisition Division (CAD) intends to negotiate on a sole source basis with Eastern Research Group Inc. (ERG) located in Chantilly, VA, to provide Enforcement, Litigation, and Technical Support for the Office of Civil Enforcement (OCE), within the Office of Enforcement and Compliance Assurance (OECA), and its regional counterparts. This procurement is being conducted under the authority of FAR Part 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The EPA is procuring the following services under this requirement: analytical, technical, and administrative support services to OCE and other EPA offices and regions, states, U.S. territories, and tribes. Major activities include case development and negotiation strategies support; developing management controls and data systems for assisting with enforcement of, and monitoring compliance with, all national enforcement initiatives and programs; targeting, developing, and implementing compliance assurance activities to monitor and improve compliance of regulated pollution sources; ensuring effective enforcement of environmental requirements; compliance monitoring including on-site inspections and investigations of pollution sources; motivating the regulated community to voluntarily discover, disclose, and correct violations; developing and implementing, in association with the National Enforcement Training Institute (NETI), enforcement related training and workshops; monitoring and enforcing federal, and federally-authorized, state programs; and providing support to regions, states, territories, tribes, and other regulatory authorities. The nature of this acquisition requires environmental enforcement support services within all statues: Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Clean Air Act (CAA); Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Toxic Substance Control Act (TSCA); Emergency Planning and Community Right-to-Know Act (EPCRA); and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) for all of the applicable statute program areas: 112(r) - RMP, Title II - Mobile Sources, 40 CFR Pt. 61 - Asbestos NESHAP, Stationary Sources, 40 CFR Pt. 82 - Stratospheric Ozone, 40 CFR Pt. 60 - Wood Heaters, CERCLA programs and CERCLA. ERG provides enforcement, litigation and technical skill for all three (air, water and waste chemical) environmental enforcement areas and records management support services with an expertise in enforcement records retention. With the required tasks of inspection and environmental compliance regulation, unbiased objectivity is critical, so the vendor must refrain from working within industry. ERG is unique in that ERG does not provide environmental compliance support services within industry. ERG is the only known source that possesses the necessary expertise to perform case negotiations support and inspections in a timely, uninterrupted, and cost-effective manner for all three environmental enforcement areas without influence or conflict of interest with industry. This requirement will utilize FAR Parts 15. The North American Industry Classification System (NAICS) code is 541620 Environmental Consulting Services with a small business size of $15,000,000.00. The government anticipates awarding a five-year Indefinite Delivery, Indefinite Quantity (IDIQ) contract type with time and material task orders. The government intends to issue a solicitation to Eastern Research group on or about June 1st, 2020. Eastern Research Group is the only known source able to satisfy this requirement. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This notice satisfies the requirement at FAR 5.101(a)(1) for publicizing the proposed contract action. Notwithstanding, any firm that believes it is capable of meeting the EPA¿s requirement MUST submit documentation if they wish to be considered. Supporting evidence must be furnished in sufficient detail to demonstrate compliance. Such documentation must be submitted electronically to young.sean@epa.gov no later than 11:59pm Eastern Time on May 7, 2020. Telephone responses will not be honored. A determination not to compete the proposed contract based upon the responses received to this notice is solely within the discretion of the Government.
