Opportunity: Notice of Intent to Sole Source: Biovia Material

Description 

In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order, on a sole source basis, to Dassault Systems Biovia Corporation (Formally Accelrys), for the period of May 1, 2016 through April 30, 2017, to purchase the annual renewal software licenses for Materials Studio Software because a significant amount of resources have previously been expended to integrate this software solution into the NETL environment, including: vendor professional services, hardware provisioning, user training, and acquiring skilled resources with expertise in this product. In addition, replacing this software with another brand would have broad sweeping consequences with significant costs: underlying data structures and infrastructure changes may be needed; migration of data to a new tool/structure would need to be planned and could result in a loss of service and further exploitation; users may need additional training on the new product; technical resources to support the new tool may be required; additional hardware may be needed; and the decommission of the current product is costly all of which would require the approval of the ECCB. If the licenses are not renewed, NETL would not be allowed to continue to use the software without being subject to penalty fees. This is considered a sole source to Dassault Systems Biovia Corporation because, to the best of the NETL’s knowledge and based on market research conducted, Dassault Systems Biovia is the only known source that can provide this type of service. No known potential alternate sources exist which could satisfy the NETL’s requirement. This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 5:00 PM ET on April 28, 2016. Responses must be submitted in writing to Robert.Mohn@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
