Opportunity: Notice of Intent to Sole Source to Waters Technologies

This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract, NOT a request for competitive quotes. The statutory authority for this sole source procurement is prescribed by FAR 8.405-6(b). The US Environmental Protection Agency (EPA), Region 5 Acquisition and Assistance Branch located at 77 W. Jackson Blvd Chicago, IL 60604, intends to award a firm fixed price sole source award to Waters Technologies Corporation, located in Milford, MA for the following items: (1) ACQUITY UPLC H-Class PLUS System - Qty 1 (2) Installation, Training and Plans – Qty 1 (3) Kits – Per fluorinated Compounds and Acquity Bottle – Qty 2 The Laboratory Services and Applied Sciences Division requires one(1) Acquity UPLC H-Class PLUS liquid chromatography system that is compatible with an existing Waters mass spectrometer. Procurement includes installation and training, 36 month warranty coverage, and required accessories and consumables (one each PFC analysis kit, isolator column, bottle accessory kit). Delivery within 30 days of order issuance. Any newly purchased equipment shall be 100 percent compatible with existing must be able to function and communicate with an existing Waters Xevo TQ-XS tandem mass spectrometer using Water proprietary software (MassLynx V 4.2). Procurement of theses Brand-Name items ensure interoperability with existing Waters brand instruments. The applicable North American Industry Classification System (NAICS) code for this requirement is 334516 - Analytical Laboratory Instrument Manufacturing. Waters Technologies Corporation has stated the company provides direct sales within the US, the manufacturer does not partner with any authorized dealers or distributors for resale of the proposed system. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government Interested vendors must respond to this notice by the due date identified on the announcement by sending an email to the Contract Specialist, Samantha Ginsburg at ginsburg.samantha@epa.gov and the Contracting Officer, Angela Carey at carey.angela.l@epa.gov.
