Notice of Intent - The Department of Energy (DOE), Office of Health, Safety and Security (HSS) is seeking to contract with Hamilton Associates, Inc., dba Air Techniques Intl. Div. (ATI), to provide Independent Inspection and Testing of High Efficiency Particulate Air (HEPA) Filters (Filter Test Facility). The intent of this action is to add a 3 month extension (which will extend the current services) and a one 3 month option period (to be exercised if a transition period is required), therefore extending the contract’s period of performance from September 30, 2019 to December 30, 2019 (or March 30, 2020, if the option period is exercised). This service includes, but is not limited to, the testing of HEPA filters to verify certain characteristics or properties which will determine acceptance or rejection of that filter and preparing reports. The HEPA filters to be tested provide critical protection to the public, workers and environment from the accidental release of radioactive materials from DOE nuclear facilities which are operated by private companies. The HEPA filters are purchased by the operating companies from various filter manufacturers, and per DOE requirements, these filters must be independently tested and accepted prior to their use. Filter manufacturers are required to ship HEPA filters to and from the FTF for independent inspection and testing. The contractor must possess and maintain the ability to provide the HEPA filter testing services in compliance with all federal, state, and local laws and regulations applicable. The contractor is responsible for obtaining and operating in compliance with all required permits and licenses. In addition to other requirements identified within the Statement of Work (SOW), all contractor activity under this scope of work shall conform to the applicable sections of the latest version of the following DOE Orders and Standards, and other national standards. In accordance with Competition in Contracting Act, 41, U.S.C 3304(a)(1), and implemented by FAR 6.302-1, other than full and open competition is authorized when there is only one responsible source and no other supplies and services will satisfy agency requirements. Due to being the incumbent contractor, Hamilton Associates Inc. is the only responsible source to extend the current contract. Implementing this extension will prevent potential barriers, to accomplishing the agency's mission, which would occur in the event of an interruption to the work currently being performed. Hamilton provides the HEPA filter testing services in compliance with all federal, state, and local laws and regulations. The incumbent also currently obtains and operates in compliance with all required permits and licenses. THIS IS A NOTICE OF INTENT AND NOT A REQUEST FOR COMPETITIVE PROPOSALS. Interested parties may submit a capability statement by September 26, 2019, at 12:00 PM EDT, via email to cathy.hanson@hq.doe.gov. Please include: Independent Inspection and Testing of HEPA Filters (Filter Test Facility) in the subject line of the email, if submitting a capability statement. All information shall be furnished at no cost or obligation to the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Responses received will be used for future acquisitions. This notice in no way obligates the Government to award any contract or carry out any contract action.
