The Government intends to negotiate, on a sole source basis, a labor hour acquisition with Attorney Peter Broida. This non-competitive action is being issued by the Acquisition Services Directorate under the authority of the Department of the Interior Franchise Fund on the behalf of the National Indian Gaming Commission (NIGC). Description of Requirement: The NIGC requires continuing legal services pursuant to those originally performed by Attorney Peter Broida for the purpose of defending the NIGC before the Equal Employment Opportunity Commission (EEOC). The professional legal services are in connection with two administrative employment discrimination cases alleging the NIGC discriminated against each respective employee. These are follow on services, to include appellate representation, performed under Contract Number D15PX00025, dated January 7, 2015, by Attorney Peter Broida, who had been representing the NIGC on these two cases since January, 2015. Although the contract expired January 6, 2016, the cases were continued before the EEOC and currently remain before the EEOC. These cases can be moved forward on the docket at any time, thus continued legal support is necessary. It is unknown when the EEOC will take action to appoint an Administrative Law Judge (ALJ) to hear this case. However, when it does happen, Mr. Broida will prepare filings and begin discovery once the litigation portion of the federal sector EEOC process begins. While these two EEOC cases are in indeterminate state, the NIGC remains in need of legal representation in these cases, which attorney Broida, who is familiar with the cases, and has been working with them since January, 2015, will provide the legal services required by NIGC. This action is being processed in accordance with FAR 13. Peter Broida has been representing the NIGC for two EEO cases. Additional services are required because the two cases have been appealed to the EEOC. The period of performance for this effort will be one year and may include option periods.
