Notice of Intent to Sole Source the Maintenance Agreement for Lifetime Support Plan (LSP) for Q400, Q500, Q600 or Q800 Systems, Lifetime Support Plan (LSP) for 1st Generation Discovery TGA, Part Academic & Lifetime Support Plan for Thermal Analysis Accessories, and Part Premium Support Contract for Q500 system. In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to TA Instruments – Waters L.L.C. NETL requires the maintenance renewal from TA Instruments as they are the original equipment manufacturer of the instruments being covered by the equipment maintenance agreement. As such, TA Instruments has proprietary knowledge of the equipment. Failure to continue the maintenance agreement through TA Instruments would put NETL at risk of failure or loss of service that could severely impact the ability to operate the equipment in an efficient and effective manner. This is considered a sole source to TA Instruments as to the best of the NETL’s knowledge, based on market research TA Instruments is the only known source that can offer the maintenance agreement for these specific instruments. No known potential alternate sources exist which could satisfy NETL's requirement. The period of performance for this requirement will include the base year plus four, one-year optional periods through 2027. This notice of intent is not a request for quote/proposal. Any interested party that believes it can meet the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 2:00 PM ET on June 15, 2022. Responses must be submitted in writing to the purchasing agent, Rebekah Parks, via email at rebekah.parks@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement.
