Notice of Intent to Award Sole Source Law Enforcement Services for the Nevada National Security Site (NNSS) Solicitation Number: 89233119RNA000062 July 11, 2019 The Department of Energy’s (DOE) National Nuclear Security Administration (NNSA) intends to award a contract to Nye County (Sheriff’s Office) by means of other than full and open competition pursuant to statutory authority 41 U.S.C. 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”, in support of the DOE NNSA Nevada Field Office (NFO). This procurement is for a five (5) year period of performance, a one year basic period followed by four 1-year option periods. This procurement is contemplated to be a Firm Fixed Price (FFP) follow-on contract to DOE NNSA Contract DE-NA0002369 for Nye County Law Enforcement Services for the NNSS in support of the DOE NNSA NFO. For this follow-on effort, the North American Industrial Classification System (NAICS) Code is 561612, Security Guards and Patrol Services, with a Small Business Size Standard of $20.5M, and the Product/Service Code (PSC) is S206, Housekeeping - Guard. In the absence of any alternative authority for the NNSA/NFO contractor protective force, the responsibility for enforcement of local laws and state statutes on the NNSS remains the responsibility of the Nye County Sheriff’s Office (NCSO), the local law enforcement agency, as mentioned in 10 CFR 1047.4. Local law enforcement services to be provided include civil and criminal law enforcement; oversight, control, and containment of public protests and demonstrations; and detention of individuals suspected of violations of Federal law until transfer to the appropriate Federal agency. Local law enforcement support is an integral part of the protection strategies employed at the NNSS. The functions of this support include traffic enforcement; investigation and collection of evidence related to traffic accidents; investigation and collection of evidence of suspected civil and criminal acts other than traffic to include providing canine support services; arrest of individuals; assistance to other Federal and local agencies in the arrest of wanted individuals; presenting testimony in the prosecution of individuals charged with violations of the law; providing emergency management support; and providing special assistance to the NNSA/NFO’s contractor protective force. As the NNSS is located entirely within the limits of Nye County, Nevada, NCSO is the only organization with the appropriate jurisdiction to carry out these services. Therefore, NCSO is the only responsible source for this procurement. Interested organizations may submit their capabilities and qualifications to perform the effort in writing via e-mail to ray.sisneros@nnsa.doe.gov not later than 5:00 p.m. Mountain Daylight Time on July 26, 2019. A determination by the Government not to compete this proposed effort on a full and open competition basis based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit their capabilities and qualifications, which shall be considered by the Government. No costs incurred as a result of replying to this notice will be reimbursed by the Government. The Government does not intend to acquire a commercial item using FAR Part 12. Oral communications are not acceptable in response to this notice.
